Term of Use

HariWang is a platform that allows employees to get a part of their salary in advance, track their daily earned wages from time to time and access to withdraw a portion of their earned wages (salary advance) based on their completed workdays.

HariWang provides Cashless Outpatient Services with a medical credit limit referred to as ‘Medical Advance’ and Employees can use the credit limit to access medical and health services through our partners.

HariWang provides Employee Benefits through our service partner and permitted other additional employee benefits or promotions which will be added to the platform from time to time subject to the terms and conditions applied.

We partnered with your employer which sign-up service agreement and contract and allow you to share with us your data (read more about this in our Privacy Policy) that is required for our services to be provided.

The Platforms and Services are available to all eligible users who are employees employed by participating employers under HariWang.

Once you as a user agree to these Terms of Use, you are agreeing for your employer to deduct the sum amount of your withdrawals or usage of limit (Salary Advance and Medical Advance) for that month from HariWang prior to paying your salary for the month. All HariWang withdrawals or usage of the limit will be observed as a company salary advance or medical advance and as such will constitute a payment of a proportion of your salary ahead of time. As such, it is important to ensure your account is only handled by you or an individual you fully trust.

As a user, you understand and accept that:

1. On your next salary disbursement date, you will receive your salary for the relevant calendar month or relevant salary period (“salary”), less the Salary Advances and Medical Advances made during that calendar month or relevant salary period and less any deductions for Other Services (“Other Deductions“) you have agreed to enroll in on the Application (your salary, less the Salary Advances and Medical Advances and Other Deductions shall mean “Net Salary”); and
2. if the aggregate value of the Salary Advance and transaction fees is equal to or greater than your Net Salary, you will not be paid anything on your next salary disbursement date and, on the salary disbursement date after that, you will receive a payment that is less the carried- over outstanding balance (if any).
3. HariWang reserves the right to suspend your right to use the platforms and services and reject any Salary Advance and Medical Advance request you have made, should you have any carried-over outstanding balance. You will only be able to continue using the platforms and services after any outstanding balances have been repaid fully.
4. HariWang and/or Its partners and/or third-party service providers may offer other services and products to you on the Application (“Other Services“), which you may enroll at your discretion. Subject to the terms and conditions of the Other Services, the payment for the Other Services may be deducted from your Salary in accordance with the clause above and agree and consent to such deductions.
5. We have a legal obligation to verify your identity and may ask you to provide information and/or documents to confirm that you made a Salary Advance and Medical Advance request. You agree to provide accurate and complete information to HariWang and inform HariWang immediately of any changes in any particulars of your Personal Information/Data. You also give us permission to make reasonable inquiries with your employer and third parties, for the same reasons. You also consent to your employer providing this information as reasonably requested by us for the purpose of these inquiries. If you are unable to provide the supporting information and/or documents for the purpose of verification of your Identity, we may suspend or terminate your use of the Platforms and Services. You hereby acknowledge that your name, email address and mobile number and such other personal information may be made available by HariWang to another third party for verification or other lawful purposes.

In registering and using the platforms and services, you hereby agree that the Platforms and Services are not a money lending service and that any money paid to you is not a loan. You acknowledge and understand that each transaction offered through the Platforms and Services is a payment arrangement between your Employer and Hariwang and pursuant to which you have agreed to assign to us the amounts owed to you by your employer as salary (“Debt”) and we have agreed to accept the assignment of Debt subject to these Terms and Conditions. By virtue of this assignment, you authorize and agree that HariWang powered by Peopleperks International Sdn Bhd shall be at liberty to receive, claim and/or recover such debt from you or your employer subject to and in the manner as set out under these Terms and Conditions.

On your salary disbursement date, you agree that your employer will, without further notice to you:

1. Deduct the monthly Salary Advances and usage limit of Medical Advance disbursed to you in accordance with these Terms and Conditions, from your monthly salary;
2. Remit and repay the amount to be deducted (including any Other Deductions) from to salary as per the clause in these terms and conditions to HariWang or any third party/service partner appointed by HariWang; and
3. Remit the Net Salary to you.

In the event your employer fails to repay the Salary Advance to HariWang, you agree to repay HariWang the Salary Advance, usage of the limit of Medical Advance and other deductions within thirty (30) days from the date of your last payday.

If the outstanding payment is not repaid when demanded, your future withdrawal requests via the platforms will be suspended without notice.

You undertake to make satisfactory arrangements for repayments of the Salary Advances, Medical Advances and other services deductions in accordance with the Terms and Conditions in any given circumstance.

Failing to repay the demanded outstanding, your information will be submitted and recorded in the systems of CTOS (Credit Reporting Agency) maintained by the Credit Reporting Agencies Act 2010 and the Central Bank of Malaysia.

The salary advances that have been disbursed are repayable on your payday or upon receipt of a repayment notice from HariWang. Without prejudice to HariWang right to recall the repayment of the Salary Advances, Medical Advance and other services that have been disbursed, HariWang shall have the right, with notice to the employer, to recall the Salary Advances, Medical Advance and other services and/or demand for full payment within seven (7) days of the date of occurrence of any event or events of default(s) including but not limited to the foIIowing:

1. presentation of a bankruptcy petition against you,
2. death or insanity;
3. if you commit a default under any provision of the Terms and Conditions;
4. if legal proceedings, suit or action of any kind whatsoever be instituted against you,
5. if any information provided by you whether in the course of making the application for the service or otherwise is incorrect or misleading or does not present an accurate representation of the relevant facts in a material particular as of be the date at which it was provided;

If you go into default under or commit a breach of any instrument or agreement relating to any such indebtedness.

Once we have received your information, we will use strict procedures and security features by applying appropriate safeguards to protect your information, prevent loss and unauthorized access. However, we expect you to take full responsibility to protect your personal and account information

on your end that is within your control and custody, to your best ability. You are expected to use secure connections when using our platforms and we shall not be held liable for any loss or issues faced due to an insecure connection. You are also expected to take full responsibility for your login details and, thus, agree to regularly change your password to ensure security.

HariWang reserves the right to terminate, delay, or suspend your access to and use of our platforms if we believe there has been fraudulent or suspicious activity related to your HariWang Account.

The Platform and Services are always available for access except “Salary Advance” which will be temporarily unavailable for any withdrawal or performed transaction request during the ‘Blackout Period’ which follows each Employer cut-off payroll date provided. The Services will resume every new refresh month.

Nonetheless, a portion of or the entire Platform may not be available on rare occasions due to system maintenance or other circumstances beyond our control. You are accorded with rights stipulated in the Personal Data Protection Act 2010 and we will be abiding by the provisions in PDPA. HariWang assumes all actions made in your account are made or authorized by you. As such, you are expected to take full responsibility for these and protect your personal data and information.
