The following terms and conditions apply to all visitors and users of this website, platform and services provided by HariWang powered by Peopleperks International Sdn Bhd. Our registered Mobile Application, our Website (www.hariwang.com.my) and the information and services offered on these platforms to you are subject to the following Terms of Use. The Mobile application and the Website will collectively be called the “Platforms”. You are bound by these Terms of Use by accessing or using our Platforms or Services.
Important – Please read these Terms and Conditions before using this Service. By continuing to use the Service (as defined below), you agreed to the Terms and Conditions and you agree that these Terms and Conditions shall be legacy binding Upon you so as long as you are using the Service. By using the Service, you acknowledge, confirm and undertake that you have read and fully understood these Terms and Conditions prior to your access to and use of the Platforms and Service. You must immediately cease your use of our Platforms and Services, if you do not agree with the Terms of Use at any time your access.
HariWang is a platform that allows employees to get a part of their salary in advance, track their daily earned wages from time to time and access to withdraw a portion of their earned wages (salary advance) based on their completed workdays.
HariWang provides Cashless Outpatient Services with a medical credit limit referred to as ‘Medical Advance’ and Employees can use the credit limit to access medical and health services through our partners.
HariWang provides Employee Benefits through our service partner and permitted other additional employee benefits or promotions which will be added to the platform from time to time subject to the terms and conditions applied.
We partnered with your employer which sign-up service agreement and contract and allow you to share with us your data (read more about this in our Privacy Policy) that is required for our services to be provided.
The Platforms and Services are available to all eligible users who are employees employed by participating employers under HariWang.
Once you as a user agree to these Terms of Use, you are agreeing for your employer to deduct the sum amount of your withdrawals or usage of limit (Salary Advance and Medical Advance) for that month from HariWang prior to paying your salary for the month. All HariWang withdrawals or usage of the limit will be observed as a company salary advance or medical advance and as such will constitute a payment of a proportion of your salary ahead of time. As such, it is important to ensure your account is only handled by you or an individual you fully trust.
As a user, you understand and accept that:
In registering and using the platforms and services, you hereby agree that the Platforms and Services are not a money lending service and that any money paid to you is not a loan. You acknowledge and understand that each transaction offered through the Platforms and Services is a payment arrangement between your Employer and Hariwang and pursuant to which you have agreed to assign to us the amounts owed to you by your employer as salary (“Debt”) and we have agreed to accept the assignment of Debt subject to these Terms and Conditions. By virtue of this assignment, you authorize and agree that HariWang powered by Peopleperks International Sdn Bhd shall be at liberty to receive, claim and/or recover such debt from you or your employer subject to and in the manner as set out under these Terms and Conditions.
On your salary disbursement date, you agree that your employer will, without further notice to you:
In the event your employer fails to repay the Salary Advance to HariWang, you agree to repay HariWang the Salary Advance, usage of the limit of Medical Advance and other deductions within thirty (30) days from the date of your last payday.
If the outstanding payment is not repaid when demanded, your future withdrawal requests via the platforms will be suspended without notice.
You undertake to make satisfactory arrangements for repayments of the Salary Advances, Medical Advances and other services deductions in accordance with the Terms and Conditions in any given circumstance.
Failing to repay the demanded outstanding, your information will be submitted and recorded in the systems of CTOS (Credit Reporting Agency) maintained by the Credit Reporting Agencies Act 2010 and the Central Bank of Malaysia.
The salary advances that have been disbursed are repayable on your payday or upon receipt of a repayment notice from HariWang. Without prejudice to HariWang right to recall the repayment of the Salary Advances, Medical Advance and other services that have been disbursed, HariWang shall have the right, with notice to the employer, to recall the Salary Advances, Medical Advance and other services and/or demand for full payment within seven (7) days of the date of occurrence of any event or events of default(s) including but not limited to the foIIowing:
If you go into default under or commit a breach of any instrument or agreement relating to any such indebtedness.
Once we have received your information, we will use strict procedures and security features by applying appropriate safeguards to protect your information, prevent loss and unauthorized access. However, we expect you to take full responsibility to protect your personal and account information
on your end that is within your control and custody, to your best ability. You are expected to use secure connections when using our platforms and we shall not be held liable for any loss or issues faced due to an insecure connection. You are also expected to take full responsibility for your login details and, thus, agree to regularly change your password to ensure security.
HariWang reserves the right to terminate, delay, or suspend your access to and use of our platforms if we believe there has been fraudulent or suspicious activity related to your HariWang Account.
The Platform and Services are always available for access except “Salary Advance” which will be temporarily unavailable for any withdrawal or performed transaction request during the ‘Blackout Period’ which follows each Employer cut-off payroll date provided. The Services will resume every new refresh month.
Nonetheless, a portion of or the entire Platform may not be available on rare occasions due to system maintenance or other circumstances beyond our control. You are accorded with rights stipulated in the Personal Data Protection Act 2010 and we will be abiding by the provisions in PDPA. HariWang assumes all actions made in your account are made or authorized by you. As such, you are expected to take full responsibility for these and protect your personal data and information.
To access our services, there will be a fee involved which will either be deducted from your requested amount or charged separately to your account based on the services being requested.
The fees and charges will be clearly presented to you during the application process within the mobile app. Please kindly review the fee structure before agreeing on the withdrawal or services performed.
HariWang reserves the right to modify or update the fees and charges and the Company’s Employees who are the users of the services will be notified of any changes in a timely manner.
Medical Advance Fees and Charges as below;
Employees of the Company can use the available medical limit that is shown in the HariWang Application Software. There will be a link directly to our service partner to log in and access the medical health services.
All fees and charges will be subject to the Partner and medical provider. The service provider exclusively offers the Medical Advance to streamline the medical treatments sought by Employees at any of the Panel Clinics.
You must notify your employer or HariWang immediately if your linked bank account information changes. The salary advance, medical advance and other services fees will charge use the linked bank account information regularly. If you do not alert HariWang of any account changes, your HariWang account and your participation in our services could be adversely impacted.
We are not liable for any of these adverse impacts and do not control the functioning of your bank account provider, thus, we will not be liable for any delays associated with the providers.
HariWang conducts its service using electronic and digital platform means and by agreeing to these terms, you acknowledge that the services are and will be provided through electronic and digital means, such as electronic or digital transactions and communication.
You acknowledge these terms and given your consent of use allows HariWang to collect relevant data (such as Name, Identification number, H/P No., Email, Employment Detail, Bank account details, Attendance data) from your employer that will be used by HariWang to provide its services and process transactions (refer privacy policy). You acknowledge that this consent is given immediately on your first sign up, onboarding and login to the application.
You further acknowledge that you signify your consent to be bound by any and all agreements, terms and conditions, and contracts in your transactions with HariWang by clicking on the “Agree” or similar button while you are logged into our platform. You agree that these agreements, terms and conditions, and contracts are binding upon you in the same manner as if you physically affixed your signature thereon.
HariWang powered by Peopleperks International Sdn Bhd owns all the rights to the website, mobile software used by the Platforms and the copyrights to the Platforms’ contents. You are prohibited to copy, use, publish, promote, integrate, or combine our software, content, or brand without our express written permission to do so. Any unlawful use or any illegal action will constitute a violation against our intellectual property and copyrights.
The parties, user of this platform acknowledge that the service provider ‘HariWang’ shall not be held liable or claim for any loss, damage, liability or expense incurred or suffered due to unauthorised access to the Customer’s account, delays on the use of our Platforms, fraudulent activities or any factors beyond our control which are claimed to result from the use of our Platforms, under no circumstances.
The parties, user and customer must indemnify and keep the service provider indemnified against all Claims arising out of, or in connection with the parties, user and customer breaching this Agreement. All parties, user and customer who use our services and Platforms is at your sole risk.
Materials provided in this Platform by HariWang are provided “as is” without warranty of any kind, either express or implied. We specifically do not make any warranties or representations as to the accuracy or completeness of any such materials.
HariWang reserve right to periodically modify or update the materials from time to time on this Platform without prior notice and your continued use of this Platform is deemed to be your acceptance of the modified terms and conditions.
